This clarification text has been prepared in accordance with the Personal Data Protection Law No. 6698 (“KVKK”) in Türkiye and the European Union General Data Protection Regulation (“GDPR”), in order to inform data owners about the methods and principles regarding the processing of Personal Data belonging to patients/consultants applying to Medialkent. The protection of the Personal Data of patients/consultants is one of the important priorities of Medialkent. Therefore, security measures in compliance with the applicable legislation are implemented by Medialkent in order to ensure that the Personal Data of patients/consultants are processed securely and to take the necessary precautions in case of unauthorized access or leakage of such data.

DATA CONTROLLER:

Your Personal Data shall be processed by Medialkent located at the OFFICIAL ACTIVITY address within the framework of KVKK No. 6698 and GDPR. Medialkent is defined as the “Controller” under GDPR. Medialkent cooperates with a Law Office specialized in Personal Data Protection Expertise, carries out data protection processes within the framework of KVKK and GDPR under the guidance of the lawyer, and the implementation responsibility belongs to the Data Controller.

YOUR PERSONAL INFORMATION SUBJECT TO PROCESSING:

Your Personal Data and Special Categories of Personal Data specified below shall be processed by Medialkent in accordance with the fundamental principles set forth in Article 4 of the KVKK and Article 5 of the GDPR; within the framework of the Personal Data Processing Conditions and Purposes defined in Articles 5 and 6 of the KVKK and Articles 6 and 9 of the GDPR, and for the purposes stated in this Clarification Text, in a lawful manner, appropriate, limited and proportionate to the purpose of processing, in accordance with the principles of fairness and transparency, accurately and up to date, by taking all technical and administrative measures stipulated in the legislation in order to ensure data security.

FOR WHAT PURPOSE YOUR PERSONAL DATA IS USED:

Your personal and special categories of personal data are processed by Medialkent in accordance with KVKK and GDPR requirements for the purposes of creating patient files, examination, preventive healthcare services, medical diagnosis, treatment, medical procedures, operations and care services, performing medical applications, conducting post-medical diagnosis and treatment and/or operation controls, managing possible complication processes, establishing direct communication with you, organizing appointments, meeting your needs such as patient satisfaction and request management, fulfilling legal and contractual obligations, protecting information regarding health data that must be stored within the periods specified in the relevant legislation, ensuring clinic security, obtaining consultancy services from other specialist physicians if necessary for the correct execution of the treatment process, fulfilling legal obligations in accordance with International Health Tourism Legislation, planning transfer and accommodation services for international health tourists, announcing innovations regarding medical treatments and applications, informing third parties about the medical services provided, carrying out promotion and marketing activities within the scope of International Health Tourism Incentive Legislation, planning and managing healthcare services and financing, fulfilling responsibilities arising from the legal relationship between the clinic and the patient, fulfilling financial and administrative obligations, ensuring technical security and fulfilling public obligations.

Your personal and special categories of personal data are processed by Medialkent within the framework of KVKK and GDPR in the following situations and conditions:

Your identity information will be used for the purposes of examination, preventive medicine, medical diagnosis, treatment, surgical intervention and care services, creation of patient files, ensuring patient satisfaction and request management, and planning transfer and accommodation services for health tourists coming within the scope of international health tourism.

Your contact information will be processed in order to carry out controls after examination, medical diagnosis, treatment and surgical procedures, and to organize appointment processes. In addition, if your explicit consent is obtained, it may also be used for informing and making announcements about medical treatments, applications and operations, reminding appointment dates in continuous treatments, and celebrating and congratulating special occasions.

We will process your health information for the successful execution of medical treatments and operations, taking necessary steps when consultation from another specialist is required during the treatment process, managing possible complications, creating patient files and storing your health data in accordance with relevant legal regulations. Your photographs, videos and audio recordings will be collected by Medialkent for monitoring the treatment process and ensuring clinic security; additionally, with your explicit consent, they may be shared with third parties within the framework of Health Tourism Incentive Legislation for promotion and information purposes aimed at health tourists planning to receive treatment in our country. Sharing your face visibly on the clinic and polyclinic’s social media accounts and official website will be carried out within ethical rules and legal frameworks. Personal data may also be published anonymously in a way that does not identify your identity, without being combined with other data. This situation will be determined by Medialkent within the framework of ethical and legal rules according to the nature of the field where the procedure is performed.

Your Financial Data will be processed in order to issue invoices and control your payments, and if any, to refund excess payments. Your Transfer and Accommodation Information will be processed for the purpose of planning transfer and accommodation services for patients and consultants within the scope of International Health Tourism. Your above-mentioned Personal Data and Special Categories of Personal Data will be processed within the framework of the legislation and purposes specified above for the realization of your medical treatment and/or operation and fulfillment of obligations related to your treatment. If you do not provide the relevant personal data, the obligations of Medialkent cannot be fulfilled properly and your operation/treatment and recovery processes cannot be carried out successfully.
